An uncontested divorce is a situation when the wife and the husband are able to agree to all the terms of the divorce.

The terms which the wife and the husband have to agree to for an uncontested divorce to occur are as follows:

  • Care and control of the children of the marriage
  • Access to the children of the marriage
  • Division of the matrimonial home

  • Maintenance for the spouse
  • Maintenance for the children of the marriage

If the wife and the husband disagree on even one of the terms of the divorce as stated above, the divorce application becomes contested.
